In this case the Court of Appeal held in favor of purchaser, which brought action for specific performance of a real estate purchase and sale agreement against seller, holding that substantial evidence supported a finding that the seller’s failure to timely comply with escrow obligations prevented loans from funding by closing date and thus excused the purchaser’s performance under the agreement.
